Terms of Use

1. What Motiq is, and what it is not

Motiq is an online venue where private individuals and businesses in the United Arab Emirates advertise cars, car parts and automotive services, and where buyers can find and contact them.

We are not a car dealer, a broker, an agent, an auctioneer, an inspection service, a valuer, a garage, an escrow service, an insurer or a finance provider. We do not take possession of anything advertised and we do not handle payment for it.

Every contract for the sale of a vehicle, part or service is made directly between the buyer and the seller. Motiq is not a party to it, does not guarantee it, and has no role in performing it.

Listings are created and controlled by their sellers. A listing is the seller's statement about their own item — it is not our statement, our recommendation, or our endorsement.

2. We do not check what is listed

We do not inspect vehicles. We do not verify mileage, service history, accident or flood damage, chassis or structural repair, engine or gearbox condition, outstanding finance or mortgage, ownership, registration, customs status, insurance history, or whether a seller is entitled to sell.

Where the site shows a badge, a rating, a trust signal, a price estimate or any similar indicator, it is generated automatically from information sellers themselves entered and from other listings on the site. It is a convenience, not a verification, not an inspection, and not a valuation.

• Anything written by our automated tools — including listing descriptions, answers to buyer questions and comparison verdicts — is generated from what the seller supplied. It is not advice and it is not a professional opinion.
• "Verified" next to a seller means only that we have seen an identity or trade document for that account. It says nothing about any vehicle they list.
• A price estimate compares a listing against others on Motiq. It is not a valuation, a survey, or an offer.

You must not treat anything on Motiq as a substitute for your own inspection, your own checks and your own professional advice.

3. If you are buying

Before you pay anyone anything, you are responsible for satisfying yourself about the item and the seller. At a minimum, for a vehicle, we strongly recommend that you:

• have it inspected by an independent garage or a testing centre before you commit to buying it;
• check the vehicle's history and any accident record through the relevant licensing authority in the emirate concerned;
• check the chassis (VIN) on the vehicle against the chassis on the registration card (mulkiya), and check the mulkiya is in the seller's name;
• confirm there is no outstanding bank finance, mortgage or lien on the vehicle, and no unpaid fines or Salik;
• meet in a safe, public place, and complete the ownership transfer through the relevant licensing authority rather than by private paperwork;
• never send money in advance to someone you have not met, and be sceptical of any seller who will not meet or who insists on an unusual payment method.

A car sold by a private individual is generally sold as it stands. Rights you may have against a seller for a defect — including any rights in respect of hidden defects under the UAE Civil Transactions Law (Federal Law No. 5 of 1985, as amended), or under the Consumer Protection Law (Federal Decree-Law No. 15 of 2020) where you are buying from a trader — are rights against that seller. They are not rights against Motiq, and nothing in these terms takes them away from you.

If a listing turns out to be inaccurate, misleading or fraudulent, tell us. We will act on it — but the person who made the statement is the person responsible for it.

4. If you are selling

You may only list something you are entitled to sell, and you must be able to prove that entitlement if asked.

Everything you say in a listing must be true, complete and not misleading. In particular you must disclose, clearly and in the listing itself:

• any accident damage, structural or chassis repair, and any flood or fire damage;
• the true mileage, including if the odometer has been replaced or is not known to be genuine;
• any outstanding finance, mortgage, lien or unpaid fine attached to the vehicle;
• whether the vehicle is a salvage, write-off, re-registered or imported vehicle, and its regional specification;
• any known mechanical or electrical fault.

You must not tamper with an odometer, conceal a defect, or use photographs that are not of the actual item.

If you are selling in the course of a business, you are responsible for holding the trade licence and permissions that UAE law requires for that business, and for meeting your own obligations to consumers — including under the Consumer Protection Law (Federal Decree-Law No. 15 of 2020) and the law on trade by modern technological means (Federal Decree-Law No. 14 of 2023). Motiq does not hold those permissions on your behalf.

You are solely responsible for your listings, your statements, and everything that follows from them. If a buyer brings a claim about something you listed, it is your claim to answer.

5. Your account

You must be at least 18 years old and legally able to enter into a contract.

Keep control of your email account and your sign-in links: anything done through your account is treated as done by you.

Give accurate account information and keep it current. One person or business, one account, unless we agree otherwise in writing.

6. What you must not do

You must not use Motiq to:

• advertise a stolen vehicle, or anything you do not own or are not authorised to sell;
• post anything false, misleading, fraudulent or deliberately incomplete;
• post anything unlawful in the UAE, or anything that offends public order or morals;
• harass, threaten, defame or abuse anyone, or post another person's private information;
• scrape, copy or bulk-extract listings or user details, or attempt to break, overload or circumvent the site's security;
• impersonate anyone, or misrepresent a business as a private sale or a private sale as a business;
• advertise anything sanctioned, prohibited or restricted under UAE law.

Conduct online in the UAE is also governed by the criminal law, including Federal Decree-Law No. 34 of 2021 on countering rumours and cybercrime. We report what we are required to report.

7. Moderation, suspension and removal

We may remove a listing, suspend an account or refuse service, at our discretion and without notice, if we believe these terms have been broken, if we receive a credible complaint, or if we are required to.

We do not review listings before they appear. Reviewing after the fact, or acting on a report, does not make us responsible for what a user posted.

If your listing is removed and you think we have got it wrong, contact us and we will look at it again.

8. Content you post

You keep ownership of your photographs and text. You give us a non-exclusive, royalty-free licence to host, display, resize and distribute them for the purpose of running and promoting Motiq, for as long as your listing is on the site and for a reasonable period afterwards in backups and records.

You confirm you have the right to give that licence — in particular, that the photographs are yours or that you have permission to use them.

9. This is a beta

Motiq is new and is currently offered free of charge while it is being built. Features may change, break or be withdrawn. Listings and messages may be lost. Do not rely on Motiq as your only record of anything.

The site is provided "as is" and "as available". To the fullest extent the law allows, we make no warranty that it will be uninterrupted, error-free, secure, or that any listing or user is genuine.

10. Our liability

To the fullest extent permitted by UAE law, Motiq is not liable for:

• the condition, quality, safety, legality, roadworthiness or description of anything advertised;
• whether a seller or buyer is who they say they are, or does what they say they will;
• any loss arising out of a transaction between users, including a vehicle that turns out to be faulty, misdescribed, damaged, stolen, financed or unfit;
• the accuracy of any automatically generated estimate, signal, badge or written summary on the site;
• loss of profit, loss of opportunity, or indirect or consequential loss of any kind.

Where we are found liable despite the above, our total liability to you for all claims connected with Motiq is limited to the greater of (a) the total fees you have paid us in the twelve months before the claim arose, and (b) AED 1,000. During the free beta, no fees are paid.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited. That includes liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, liability for our own gross negligence or wilful misconduct, and any right you have under the UAE Consumer Protection Law that cannot be contracted out of. If any part of this section is held to be unenforceable, the rest of it still applies.

11. You cover us for what you cause

If someone brings a claim against us because of something you posted, something you did on Motiq, or a transaction you were part of, you will indemnify us for the resulting losses, damages and reasonable legal costs — except to the extent the claim arises from our own fraud, gross negligence or wilful misconduct.

12. Disputes between users

Disputes about a sale are between the buyer and the seller. We are not an arbitrator and we do not adjudicate them.

We may, entirely at our discretion, provide records to either party or to the authorities where the law allows or requires it.

13. Your personal data

How we handle personal data is set out in the Privacy Policy, which forms part of these terms. It follows the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021).

14. Changes to these terms

We may change these terms. If a change is material, we will publish a new version and ask you to accept it the next time you use the site. Continuing to use Motiq after accepting a new version means the new version applies.

Each version is recorded, along with the date you accepted it.

15. Electronic agreement

You agree that ticking the acceptance box is your signature for the purposes of the UAE Electronic Transactions and Trust Services Law (Federal Decree-Law No. 46 of 2021), and that our record of your acceptance — the version, the time, and the technical details of the request — is admissible evidence of it.

16. Governing law and jurisdiction

These terms are governed by the federal laws of the United Arab Emirates and, where applicable, the laws of the Emirate of Dubai.

Any dispute is subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

If these terms are ever published in Arabic as well as English and the two differ, the Arabic version prevails.

17. General

If any provision is found unenforceable, the rest continues to apply.

Not enforcing a term once does not mean giving it up.

You may not transfer your rights under these terms. We may transfer ours to a company that takes over the operation of Motiq.
